오는 9월 유엔 총회 상정을 목표로 국제장애인권리조약 최종안을 작성하고 있는 제8차 특별위원회가 21일 회의를 통해 총 6개의 조항을 만장일치로 채택했다.
각 정부대표단이 가장 먼저 합의한 6개 조항은 제10조 생명권, 제14조 개인의 자유와 안전, 제19조 자립적 생활과 사회통합, 제22조 사생활 존중, 제30조 문화생활, 레크리에이션, 여가생활과 스포츠 참여, 제31조 통계와 자료수집.
이들 조항들은 더 이상 이번 특별위원회에서 수정되거나 논의되지 않고 유엔 총회로 간다. 이번 금요일까지 앞으로 28개의 조항을 더 마무리해야 예정했던 작업이 모두 끝이 난다.
지난 주말동안 뉴질랜드 대사 돈 멕케이 의장은 각 정부대표단들로부터 마지막으로 제시하기를 원하는 제안을 모두 취합했다. 21일 오전까지 취합된 각 정부대표단의 제안은 약 140건에 이른다.
돈 멕케이 의장은 “140여개 제안에 대해 다시 한번 일반적인 논의는 할 수 없을 것이다. 각 제안별로 10분씩만 투자해도 25시간, 한주가 더 필요하다. 합의점을 이끌어내는데 목표를 두고 회의에 임해 달라”고 당부했다.
이날 회의는 각 제안들을 조항 순서대로 점검해가며 이견이 없으면 곧바로 투표를 통해 채택하는 방식으로 진행됐다. 제안을 내놓은 나라로부터 간단한 설명을 들은 뒤, 이를 반대하는 나라는 손을 들어 의사를 표시하도록 했다. 반대가 한 곳도 없으면 그 조항은 자동적으로 채택되는 것.
자신들의 제안을 조약안에 포함시키려면 24시간 안에 반대하는 국가들과 비공식 협의를 갖고, 동의를 이끌어내 다시 본회의로 가져와야한다. 본회의에서 만장일치를 얻어야 만이 그 제안이 받아들여질 수 있다.
돈 멕케이 의장은 “본질적인 부분에서 문제가 되지 않거나 조약의 정신에 위배가 되지 않는다면 여러분들이 그냥 넘겨주었으면 한다”면서 “모든 내용을 반영하는 조약을 만들 수는 없다”고 말했다.
21일 회의에서는 140여개의 모든 제안들에 대해서 찬반을 묻는 작업은 완료했다. 이날 만장일치를 얻어 통과되는 제안은 거의 없었다. 한 곳의 반대라도 있으면 통과될 수 없다. 일부 국가들이 반대 의견을 접하고, 제안을 철회하기로 즉석에서 결정할 때에는 박수 소리가 터져 나왔다.
앞으로 특별위원회는 각 정부대표단들이 수정해서 가져오는 제안들을 다시 취합해 찬반을 묻는 작업을 진행할 예정이다. 만장일치를 얻어야만 그 제안이 받아들여지게 됨으로 지금 단계에서 조약안이 크게 수정될 일은 없을 것이라는 것이 일반적인 분석이다.
한편 국제장애인권리조약한국추진연대 장애여성네트워크는 21일 공식 일정을 마친 뒤, 각국 장애여성 엔지오 참가자들을 초청해 만찬을 갖고, 장애여성조항을 포함한 트윈트랙 방식이 조약안에 포함되게 된 것을 자축했다.
Article 10 Right to life
States Parties reaffirm that every human being has the inherent right to life and shall take all necessary measures to ensure its effective enjoyment by persons with disabilities on an equal basis with others.
제10조 생명권
당사국 정부는 모든 인류가 천부적 생명권을 부여받았음을 재확인하고 제반의 필요한 대책을 마련하여 비장애인과 동등하게 이 권리를 효과적으로 누릴 수 있도록 보장해야 한다.
Article 14 Liberty and security of the person
1. States Parties shall ensure that persons with disabilities, on an equal basis with others:
(a) Enjoy the right to liberty and security of the person;
(b) Are not deprived of their liberty unlawfully or arbitrarily, and that any deprivation of liberty is in conformity with the law, and in no case shall the existence of a disability justify a deprivation of liberty.
2. States Parties shall ensure that if persons with disabilities are deprived of their liberty through any process, they are, on an equal basis with others, entitled to guarantees in accordance with international human rights law and shall be treated in compliance with the objectives and principles of the present Convention, including by provision of reasonable accommodation.
제14조 개인의 자유와 안전
1. 당사국 정부는 장애인과 비장애인이 평등함을 다음의 사항에서 보장해야 한다:
a) 개인의 자유와 안전에 관한 권리를 누린다.
(b) 장애인은 불법적인 형태 혹은 임의적으로 자유를 박탈당하지 않으며, 자유를 박탈해야 할 경우에는 법을 준수해서 이가 이루어지도록 하며 어떠한 경우에도, 장애를 이유로 해서 장애인의 자유를 박탈하는 것이 정당화 될 수 없다.
2. 당사국 정부는 장애인이 자유를 박탈당할 경우, 장애인은 비장애인과 동등하게 국제 인권법에서 보장하는 사항들에 대한 권리가 있으며, 합리적인 처우 제공을 통해, 본 조약의 원칙과 목표가 준수되는 방식으로 대우 받아야 한다는 점을 보장해야 한다.
Article 19 Living independently and being included in the community
States Parties to the present Convention recognize the equal right of all persons with disabilities to live in the community, with choices equal to others, and shall take effective and appropriate measures to facilitate full enjoyment by persons with disabilities of this right and their full inclusion and participation in the community, including by ensuring that:
(a) Persons with disabilities have the opportunity to choose their place of residence and where and with whom they live on an equal basis with others and are not obliged to live in a particular living arrangement;
(b) Persons with disabilities have access to a range of in-home, residential and other community support services, including personal assistance necessary to support living and inclusion in the community, and to prevent isolation or segregation from the community;
(c) Community services and facilities for the general population are available on an equal basis to persons with disabilities and are responsive to their needs.
제19조 자립생활 및 장애인의 지역 사회로의 통합
본 조약의 당사국 정부는 장애인이 비장애인과 동등하게 지역 사회에서 살아갈 권리가 있으며, 비장애인과 동등한 선택권이 있다는 점을 인지하며, 효과적이고 적절한 조치를 취해 장애인이 이러한 권리를 온전히 향유하고, 지역 사회에 온전히 통합되고, 참여하는 것을 촉진시켜야 한다. 이를 위해 다음을 보장한다:
(a) 장애인들은 비장애인과 마찬가지로 거주지 선택의 자유, 어디서 누구와 살 것인가에 대한 선택의 자유를 가지며 특정한 거주형태에 사는 것을 강요받지 않는다.
(b) 장애인의 생활과 지역사회로의 결합을 지원하고 지역사회로부터 소외되거나 격리되는 것을 방지하기 위하여 필요한 개별지원을 포함하여 각종 가정 내 지원서비스, 주거 지원서비스, 그리고 지역사회의 지원 서비스에 접근하여야 한다.
(c) 일반인을 위한 지역사회 서비스 및 시설은 장애인에게도 동등한 기준으로 이용 가능해야 하며 장애인의 욕구에 부합되어야 한다.
Article 22 Respect for privacy
1. No person with disabilities, regardless of place of residence or living arrangements, shall be subjected to arbitrary or unlawful interference with his or her privacy, family, home or correspondence or other types of communication or to unlawful attacks on his or her honour and reputation. Persons with disabilities have the right to the protection of the law against such interference or attacks.
2. States Parties shall protect the privacy of personal, health and rehabilitation information of persons with disabilities on an equal basis with others.
제22조 사생활 존중
1. 장애인 어느 누구도 주거지역이나 거주형태와 무관하게 개인의 사생활, 가족, 가정 또는 서신왕래 및 기타 여러 형태의 의사소통에 관해 임의적 혹은 비합법적으로 침해 받거나, 그들의 명예와 명성에 대하여 비합법적인 공격 대상이 될 수 없다.
2. 당사국 정부는 비장애인과 동등하게 장애인의 사생활, 건강 및 재활 등 개인정보를 보호해야 한다.
Article 30 Participation in cultural life, recreation, leisure and sport
1. States Parties recognize the right of persons with disabilities to take part on an equal basis with others in cultural life, and shall take all appropriate measures to ensure that persons with disabilities:
(a) Enjoy access to cultural materials in accessible formats;
(b) Enjoy access to television programmes, films, theatre and other cultural activities, in accessible formats;
(c) Enjoy access to places for cultural performances or services, such as theatres, museums, cinemas, libraries and tourism services, and, as far as possible, enjoy access to monuments and sites of national cultural importance.
2. States Parties shall take appropriate measures to enable persons with disabilities to have the opportunity to develop and utilize their creative, artistic and intellectual potential, not only for their own benefit, but also for the enrichment of society.
3. States Parties shall take all appropriate steps, in accordance with international law, to ensure that laws protecting intellectual property rights do not constitute an unreasonable or discriminatory barrier to access by persons with disabilities to cultural materials.
4. Persons with disabilities shall be entitled, on an equal basis with others, to recognition and support of their specific cultural and linguistic identity, including sign languages and deaf culture.
5. With a view to enabling persons with disabilities to participate on an equal basis with others in recreational, leisure and sporting activities, States Parties shall take appropriate measures:
(a) To encourage and promote the participation, to the fullest extent possible, of persons with disabilities in mainstream sporting activities at all levels;
(b) To ensure that persons with disabilities have an opportunity to organize, develop and participate in disability-specific sporting and recreational activities, and to this end, encourage the provision, on an equal basis with others, of appropriate instruction, training and resources;
(c) To ensure that persons with disabilities have access to sporting and recreational and tourism venues;
(d) To ensure that children with disabilities have equal access to participation in play, recreation, and leisure and sporting activities, including those activities in the school system;
(e) To ensure that persons with disabilities have access to services from those involved in the organization of recreational, tourism, leisure and sporting activities.
제30조 문화생활, 레크리에이션, 여가생활과 스포츠 참여
1. 당사국 정부는 비장애인과 동등한 입장에서 장애인이 문화생활에 참여할 권리가 있음을 인정하고 모든 적절한 대책을 수립하여 장애인을 위한 다음의 사항을 보장하도록 한다:
(a) 모든 접근가능한 형태로 문화적 자원을 향유할 권리;
(b) 모든 접근가능한 형태로 TV 프로그램, 영화, 연극 및 기타 문화활동을 향유할 권리;
(c) 극장, 박물관, 영화관, 도서관, 관광여행 서비스와 같은 문화 활동 및 관련 서비스를 위한 장소에 대한 접근성과, 국가의 중요한 기념관 및 문화적 명소 등에 대한 접근성을 가능한 한 향유할 권리
2. 당사국 정부는 모든 적절한 조치를 마련하여, 자신의 이익뿐만이 아닌 풍요로운 사회를 위한 창조적이고, 예술적이며, 지적인 잠재력을 개발하고 활용할 수 있는 기회를 보장해야 한다.
3. 당사국 정부는 국제법에 따라 모든 적절한 대책을 수립하여 지적 재산권을 보호하기 위한 법률이 장애를 가진 사람들의 문화적 자료 접근에 불합리한 혹은 차별적인 장벽이 되지 않도록 모든 적절한 조치를 취해야 한다.
4. 비장애인과 평등한 입장에서, 수화 및 청각장애인의 문화를 포함하여 장애인은 특정한 문화적, 언어적 정체성을 인식하고 지원받을 자격이 있어야 한다.
5. 당사국 정부는 비장애인과 동등한 입장으로 레크리에이션, 여가생활, 스포츠 활동에 참여할 수 있다는 관점에서 다음의 조치를 수립해야 한다.
(a) 주류 스포츠 활동의 전 영역에서 장애인이 가능한 최대로 참여할 수 있도록 격려하고 촉진한다;
(b) 장애인의 장애별 특화된 스포츠와 레크리에이션 활동을 조직, 개발하고 참여할 기회를 보장하고, 이를 위해 비장애인과 동등한 입장에서 적절한 지침, 훈련 및 자원의 공급을 보장한다;
(c) 스포츠, 레크리에이션 및 관광여행 현장에 대한 장애인의 접근성을 보장한다; (d) 장애아동이 학교 시스템 및 학교생활을 포함한 놀이, 레크리에이션, 여가생활 및 스포츠 활동에 평등하게 참여할 수 있도록 보장한다; (e) 레크리에이션, 관광여행, 여가 및 스포츠 활동 조직에 연관된 것들로부터 서비스에 대한 장애인의 접근성을 보장한다.
Article 31 Statistics and data collection
1. States Parties undertake to collect appropriate information, including statistical and research data, to enable them to formulate and implement policies to give effect to the present Convention. The process of collecting and maintaining this information shall:
(a) Comply with legally established safeguards, including legislation on data protection, to ensure confidentiality and respect for the privacy of persons with disabilities;
(b) Comply with internationally accepted norms to protect human rights and fundamental freedoms and ethical principles of statistics.
2. The information collected in accordance with this article shall be disaggregated as appropriate and used to help assess the implementation of States Parties’ obligations under the present Convention, and to identify and address the barriers faced by persons with disabilities in exercising their rights.
3. States Parties shall assume the responsibility for the dissemination of these statistics and ensure their accessibility to people with disabilities and others.
제31조 통계와 자료수집
1. 당사국 정부는 통계 및 연구 자료를 비롯한 적절한 정보를 수집해서, 본 조약을 준수하는 정책을 입안, 이행하도록 해야 한다. 이러한 자료의 수집 및 유지는 다음과 같도록 한다:
(a) 장애인의 사생활 존중 및 사생활 비밀 유지를 보장하기 위한 데이터 보호에 관한 법률 제정을 비롯해 보호 장치를 준수한다;
(b) 인권과 기본적 자유권 그리고 통계상의 윤리적 원칙을 보호하는 국제적으로 허용되는 규범을 준수한다.
2. 본 조항에 의거하여 수집된 정보는 적절하게 분리 수집-성별, 연령별 통계를 의미함-되어야 하며 본 조약에 속한 당사국 정부의 이행여부 평가를 돕기 위해 사용되어야 한다. 또한 장애인의 권리행사에 있어서 직면하는 장벽을 규명하고 발표하는데 사용되어져야 한다.
3. 당사국 정부는 이러한 통계 배포에 대한 책임을 수용해야 하며, 장애인과 기타 관계자들의 접근성을 보장해야 한다. |
